Probate solicitors for Orange, Bathurst and the Central West
Orange and Bathurst are the twin hubs of Central Western NSW, with economies anchored by agriculture, mining, health, and education. The region's strong wine industry and growing professional services sector mean that estates are increasingly diverse. Julia Clarke Solicitor assists executors and administrators across Orange, Bathurst, Cowra, Cabonne, Blayney, and surrounding areas with the full probate process.
All NSW probate applications are filed in the NSW Supreme Court's Probate Registry. We act remotely for Central West clients and communicate by phone, email, and video conference throughout the matter.
Grant of probate
A grant of probate authorises the named executor to deal with the deceased's assets. Central West estates frequently include agricultural land, interests in wine-growing operations, mining tenements or royalties, and significant financial assets. We prepare the full probate application and coordinate with specialist valuers as required.
Letters of administration
Where the deceased died without a will, or the named executor cannot act, letters of administration must be obtained from the NSW Supreme Court. We advise administrators on their entitlements and obligations under the intestacy rules in the Succession Act 2006 (NSW), including in circumstances involving complex family structures.
Estate administration after the grant
Following the grant, the executor must collect all estate assets, pay debts and liabilities, attend to final tax obligations, and distribute the estate. For Central West estates, this may involve coordinating with the Department of Primary Industries and Environment for transfers of mining tenements, with NSW Land Registry Services for real property, and with specialist accountants on CGT and other tax matters.
Complex and contested estates
We advise on family provision claims, contested wills, and executor disputes. We provide frank advice on your prospects and can refer to specialist equity counsel where litigation in the NSW Supreme Court is required.
