Probate solicitors for Central Coast estates
The Central Coast has experienced significant population growth and a strong property market, meaning that Central Coast estates increasingly involve high-value real property alongside the usual bank accounts and personal assets. Julia Clarke Solicitor assists executors and administrators throughout the Central Coast with the full probate process.
Probate applications are filed in the NSW Supreme Court's Probate Registry. We prepare all documents, file on your behalf, and communicate by phone, email, and video conference. Central Coast clients do not need to travel to our East Maitland office.
Grant of probate
A grant of probate is required where the deceased left a valid will and the named executor applies to administer the estate. For Central Coast estates, the most common assets requiring a grant include residential and holiday property around Gosford, Wyong, and the lake and coastal suburbs, along with financial assets held with major banks and investment platforms.
We prepare the application for probate, the supporting affidavit, the inventory of assets and liabilities, and the notice of intended application. We file all documents in the Probate Registry and obtain the grant on your behalf.
Letters of administration
Where the deceased died without a will, or the named executor cannot act, letters of administration must be obtained. The estate is distributed according to the statutory formula under the Succession Act 2006 (NSW). The Central Coast's substantial retiree and semi-retiree population means we regularly handle intestate estates involving significant superannuation and property assets. We advise administrators carefully on their entitlements and obligations.
Estate administration after the grant
Once the grant is obtained, the executor or administrator must collect assets, pay debts, and distribute the estate. For Central Coast estates, real property is often the principal asset and must be transferred through NSW Land Registry Services or sold at the direction of the executor. We assist throughout the administration process and advise on potential executor liability.
Complex and contested estates
We advise on family provision claims, contested wills, and executor disputes. The Central Coast's demographics — with significant numbers of retired and elderly residents — means that family provision applications are not uncommon, particularly in blended family situations. We provide frank advice on your prospects and can refer to specialist counsel where required.
