Grant of probate — NSW and cross-border estates
A grant of probate issued in NSW authorises the executor to deal with assets in NSW. Where the deceased held assets in Victoria as well as NSW, a separate application or resealing may be required in the Supreme Court of Victoria. We advise executors on the most efficient approach to obtaining the authority needed to deal with assets in each jurisdiction, and can coordinate with Victorian solicitors as required.
Letters of administration
Where the deceased died without a will, letters of administration must be obtained. The intestacy rules of the jurisdiction where the deceased was domiciled apply to determine who is entitled to share in the estate. For Albury residents, this is ordinarily NSW law. We advise administrators on their entitlements and obligations under the Succession Act 2006 (NSW).
Estate administration after the grant
Following the grant, the executor must collect all assets, pay debts, attend to final tax obligations, and distribute the estate. For Murray Region estates, this often involves coordinating with NSW and Victorian land registries, dealing with major rural banks, and managing agricultural interests spanning both states. We provide ongoing advice throughout the administration and coordinate with specialist accountants on tax matters.
